On 18 September 2018, the Constitutional Court ruled that the private cultivation and private consumption of cannabis by consenting adults is not a criminal offence and directed Parliament to amend the relevant legislation within 24 months. The decriminalisation of private cannabis use aligns with developments all over the world where the medical and recreational use of cannabis is increasingly being legalised. These developments create business opportunities, new markets and new challenges in the workplace. In particular, many employers have noted an increase in incidents of possession and use of cannabis in the workplace since then, resulting in disciplinary action being taken against employees for misconduct.
